Small Claims is an informal court where individuals can sue for monetary damages only up to $3,000 maximum in the Town and Village Court. Claims over $3000 but not exceeding $5,000 can be directed to a City Court. The person or business you are suing MUST reside or have an office for business in the Town of Lancaster.
To start a small claim, you must come to the Court Office and complete a small claims application in which you will need the name and address of the party to be sued and the exact dollar amount. A filing fee of $10 is required for claims up to $1,000. A $15 fee is required for claims $1,000 to $3,000. A future court date will be scheduled.
